These Terms of Use (“Terms”) govern your use of https://aerialvpdrone.com (the “Site”) operated by Aerial Video Precision Drone, L.L.C. (“Company”, “we”, “us”, or “our”).

 

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

 

1. Use of the Site

You may use the Site only for lawful purposes.  You agree not to:

  • Violate any applicable laws or regulations;

  • Interfere with or disrupt the Site or our systems;

  • Attempt to gain unauthorized access to any part of the Site;

  • Use the Site to transmit any harmful, fraudulent, or offensive content.

 

We may suspend or terminate access to the Site at any time if we believe you have violated these Terms.

These Terms govern access to and use of the Company’s website only.  Any drone services, aerial imaging, mapping, or related deliverables (collectively, “Services”) are governed exclusively by a separate written agreement, proposal, statement of work, or invoice terms (each, a “Services Agreement”), if any.  In the event of a conflict between these Terms and any Services Agreement, the Services Agreement shall control.

2. Informational Nature of Website; No Guarantee of Services

The website is provided for general informational purposes and to facilitate inquiries regarding potential Services.  Any descriptions of Services, capabilities, regulatory considerations, or project feasibility are illustrative only and do not constitute a binding offer or guarantee.

 

The Company’s ability to perform Services is subject to, among other things, applicable laws and regulations (including, but not limited to, FAA rules), airspace authorizations, weather conditions, equipment availability, site conditions, and safety considerations. The Company does not guarantee that any requested operation will be approved, scheduled, or completed.

Any final scope, pricing, timing, deliverables, and conditions of performance will be set forth, if at all, in a separate Services Agreement.

3. Intellectual Property

All content on the Site (text, images, logos, videos, design, etc.) is owned by us or our licensors and protected by law. You may view the Site and make a single personal, non‑commercial copy of materials for reference. You may not reuse, copy, or distribute Site content for other purposes without our written permission.

 

Any photographs, videos, maps, models, or other materials created by the Company in connection with Services (“Deliverables”) are not governed by these Terms.  Ownership, licensing rights, and permitted uses of Deliverables shall be governed exclusively by the applicable Services Agreement. No rights in Deliverables are granted by these Terms.

4. User Submissions

If you contact us or send project information, files, or other materials: You represent and warrant that you have all rights, authority, and permissions necessary to submit such information, including any location data, project specifications, or site-related materials, and that such submissions do not violate any law or third-party rights.

 

You are responsible for ensuring any mapping or geospatial data you provide can legally be shared with us and with any third‑party processing services we use.  The Company may rely on the accuracy and completeness of all submitted information without independent verification.

 

You are responsible for how you share any links, data, or deliverables we provide, including access to third-party hosted mapping or visualization platforms

 

5. Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Site, to understand our practices regarding the collection and use of your information, including data collected during drone operations.

6. Third Party Links and Services

The Site may link to third‑party websites and services, including social media (such as Facebook and LinkedIn) and mapping platforms. We do not control these sites and are not responsible for their content or policies. Your use of third-party sites is subject to their own terms and privacy policies, and is at your own risk.

7. Client Responsibilities and Site Conditions


To the extent you request or engage the Company for Services, you acknowledge and agree that:

(a) Authority.  You have full legal authority to request Services at the location(s) identified, including authority from property owners, tenants, or other relevant parties.

(b) Permissions.  You are responsible for obtaining any non-FAA permissions, approvals, consents, or releases required for the requested Services, including but not limited to property access permissions, HOA approvals, event permissions, or private-party consents.

(c) Accuracy of Information.  All information you provide regarding the project, location, and conditions is accurate and complete.

(d) Safe Conditions.  You will ensure that the site is reasonably safe and suitable for operations, including identifying hazards, restricted areas, or sensitive conditions.

(e) Cooperation.  You will provide reasonable cooperation, access, and coordination necessary for the Company to perform Services.

The Company may rely on the foregoing representations without independent investigation.

The Company reserves the right, in its sole discretion, to modify, delay, suspend, or refuse any operation if it determines that performance would be unsafe, unlawful, impractical, or inconsistent with professional or regulatory standards.

8. Drone Operations and FAA Compliance

The Company operates drone services in accordance with applicable U.S. Federal Aviation Administration (“FAA”) regulations, including Part 107 for commercial unmanned aircraft operations, where required.

Insurance: We maintain appropriate insurance coverage for our drone operations as required by law and industry standards.

 

You are responsible for:

  • Ensuring we have lawful access to the property or location where services are requested;

  • Obtaining any non‑FAA permissions or approvals (for example, from property owners or local authorities);

  • Not requesting services that would require us to violate FAA rules or other laws.

 

We reserve the right to decline or modify any job that, in our judgment, cannot be performed safely or legally under applicable regulations.

9. Safety, Weather, and Operational Discretion

The Company retains sole and absolute discretion regarding all operational decisions. The Company may, at any time and without liability, modify, delay, reschedule, or cancel any planned operation due to:

  • weather conditions (including wind, visibility, precipitation, or temperature),

  • airspace restrictions or denials,

  • temporary flight restrictions (TFRs),

  • proximity to manned aircraft or emergency activity,

  • equipment limitations or malfunctions,

  • GPS interference or signal degradation,

  • unsafe site conditions, or

  • any other factor affecting safety, legality, or feasibility.

 

No representation or prior discussion shall be deemed a guarantee that any operation can or will be completed.

10. Service Delivery and Scheduling

Weather and Conditions: Drone operations are subject to weather conditions and FAA flight restrictions. We reserve the right to reschedule or delay services due to unsafe weather conditions, airspace restrictions, or other factors beyond our control.

Rescheduling: If we need to reschedule due to weather or safety concerns, we will work with you to find an alternative date at no additional charge.

Delivery Timelines: While we strive to meet agreed-upon delivery schedules, final delivery may be subject to post-processing time and any necessary re-flights due to technical issues.

11. Cancellation and Refund Policy:

Client Cancellations: For contracted services, the cancellation and refund terms set forth in the applicable Services Agreement or Quote will control in the event of any conflict.

 

Weather-related cancellations by us: If we cancel due to unsafe weather, flight conditions, or safety concerns, you will receive a full refund or rescheduling at no additional charge.

Equipment Issues: If we are unable to complete services due to equipment failure, you will receive a full refund or rescheduling at no charge.

Force Majeure:  We are not liable for delays or inability to perform services due to circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, government restrictions, or equipment failures not caused by our negligence.

12. Disclaimer of Warranties


The Site and its content are provided “as is” and “as available”, without warranties of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non‑infringement.

 

We aim to keep the Site available, secure, and functioning properly, but we do not guarantee that the Site will be uninterrupted, secure, or error‑free, or that any defects will be corrected.

 

Mapping, imagery, and geospatial data provided through our services are for informational purposes only and are not guaranteed to be accurate, complete, or suitable for legal, engineering, or surveying use.

The Company disclaims any liability arising from inability to perform Services due to regulatory restrictions, denied authorizations, third-party actions, weather conditions, or circumstances beyond its control.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW:

(a) Website Use.  The Company shall not be liable for any damages arising out of or related to your use of or inability to use the website.

(b) Services.  To the extent any claim relates to Services, and only if a Services Agreement does not provide otherwise, the Company’s total cumulative liability shall not exceed the total amount actually paid to the Company for the specific Services giving rise to the claim.

(c) Excluded Damages.  In no event shall the Company be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to lost profits, lost business opportunities, delay damages, or loss of data.

(d) Operational Risks.  The Company shall have no liability for failure or delay caused by weather, regulatory constraints, denied flight approvals, site conditions, third-party interference, or circumstances beyond its reasonable control.

14. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its members, managers, employees, contractors, and agents from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

(a) your use of the website;
(b) your breach of these Terms;
(c) your violation of any law or regulation;
(d) your failure to obtain required permissions or authority for a project;
(e) inaccurate or incomplete information you provide;
(f) unsafe or unsuitable site conditions; or
(g) any dispute arising from or related to the requested Services.

15. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date reflects when they were last revised. Your continued use of the Site after changes means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of the State of Texas. Any dispute related to these Terms or the Site will be handled in the state or federal courts located in Comal County, Texas, and you agree to their jurisdiction.
